A consumer proposal can be filed by anyone owing creditors less than $250,000 (excluding the mortgage(s) on their principal residence) and if the debtor is insolvent, in other words, is unable to pay their debts as they generally come due. That fact that no payments have been missed;does not preclude the filing a consumer proposal.
