If you’ve been bankrupt before, then you will not qualify for what is known as an “automatic discharge” after 9 months. Instead, the trustee will have to set an appointment with the courts, and the courts will make the decision on how long you will be in bankruptcy. The length of time will depend on a number of factors – how long ago the first bankruptcy occurred, the reasons for both bankruptcies, and other things. Generally, you will be in bankruptcy at least a further 3 months (for a total of 12 months), but it could be longer than that depending on the factors discussed above as well as the locality of the court.
