Power Of Attorney Can I File A Bankruptcy For That Person

  A bankruptcy can be filed by a “person” or by an executor for a deceased person. The definition of "person" in the Bankruptcy and Insolvency Act includes legal representatives of that individual according to the laws of the province. So the question will be....... whether or not your Power Of Attorney is worded such that you are appointed as their legal representative with the Powers to govern these financial affairs. If in doubt, you can always make an application before a Bankruptcy Court to affirm your appointment as the "person" according to the Bankruptcy Act.
