Sponsoring Immigrant While In Bankruptcy
2009-07-09 minute read
A suspended discharge is a term used by the Court at your Discharge hearing to say that they are giving you a Discharge from bankruptcy, but it won't take effect until the suspension period has expired. So in your case.....your Discharge was suspended for 6 months. Your discharge will not take effect until that future date. So until then, you are still an undischarged bankrupt. This is common for people who have had a previous bankruptcy.....they won't receive a discharge as fast as a first-time bankrupt. You need to dislose the fact that you are still in bankruptcy during this suspension period, even though you are not reporting to your Trustee any longer. And I do believe that an undischarged Bankrupt can NOT sponsor an immigrant. The Government requires that you are financially responsible for any family members that you sponsor into Canada. And being in bankruptcy will likely affect this financial responsibility. I would anonymously contact the Immigration department...but your sponsorship will likely be denied until you are discharged from your bankruptcy.
