Refunds for the year you declared bankruptcy and for any previous years have to go into your bankruptcy for the creditors. This is a legal requirement under bankruptcy law in Canada. Canada Revenue Agency is required to send the refunds directly to your trustee. So, if you declared bankruptcy in 2010, you will lose any refunds for 2010 and previous years, but your 2011 tax refund belongs to you (unless there was a court order in your bankruptcy saying otherwise).
